Terms of Use

These Terms govern your use of bonadomus.com (the “Site”), including its listings, search tools, articles, forms and messenger links. By using the Site, you agree to them. If you do not agree, do not use the Site.

They cover this website only. They do not cover other websites operated under the Bonadomus name in other countries, which publish their own terms, and they do not cover a purchase transaction, which is governed by the agreements you sign for it (see Section 4).

Bonadomus operates the Site. In these Terms, “we,” “us” and “our” mean Bonadomus. Our contact details are in Section 23.

Property inquiries submitted through the Site are answered by the licensed real estate agent who works with us, Amalia Vargas, Florida license SL3205445. She holds her license with Beachfront Realty Inc, brokerage license CQ1003624, broker Mindy Kurkin, license BK0691034. Real estate brokerage services are provided by licensed professionals under that brokerage’s license, not by the Site.

The Site serves the United States real estate market. It is not directed at children. You must be at least 18 to submit a form or contact us about a property, and by doing so you confirm that you are.

Browsing the Site, reading an article, viewing a listing or submitting an inquiry does not by itself make you a client of our agent or the brokerage, and does not create any agency, fiduciary, legal, tax, financial or other professional relationship.

If your inquiry moves toward a transaction, the agent, Beachfront Realty Inc, and other parties such as a title company or lender will give you the disclosures and agreements the law requires. Those documents, not these Terms, govern that relationship.

Some buyers are restricted by law. For example, Part III of Chapter 692, Florida Statutes, limits purchases of Florida real property by certain foreign principals. Whether a restriction applies to you is decided in the transaction, with professional advice, and not by anything on the Site.

5.1 Accuracy

Listing information comes from developers, listing brokers and other third-party sources. It is deemed reliable but not guaranteed. Price, availability, status, measurements, room counts, amenities, association rules, taxes, insurance, flood zone, zoning and permits change and can contain errors or omissions. Verify every fact that matters to you before you make a decision or sign anything.

Measurements shown in square meters or square feet are converted and rounded, and are approximate.

5.2 MLS listing data

When the Site displays listing data from a multiple listing service (MLS) through an Internet Data Exchange (IDX) program, that display is provided under the IDX participation of Beachfront Realty Inc and operates under its supervision and control. MLS listing data is provided for your personal, non-commercial use, and only to identify properties you may be interested in buying or renting. Listings can be held by brokerages other than Beachfront Realty Inc, and each listing shows the listing brokerage where the MLS rules require it.

You may not remove, hide or alter any MLS, listing-broker, developer or photographer attribution shown on the Site.

The Site includes new developments and pre-construction projects. Prices, availability, floor plans, deposit schedules, completion dates, amenities, renderings and photographs for these projects are supplied by the developers and change without notice.

Renderings and plans are illustrations and do not necessarily show the finished property. Nothing on the Site is an offer by a developer. Only a signed contract with the developer binds either side. Confirm every detail with the developer and our agent.

Our articles, market reports, neighborhood guides, cost estimates and comparisons are general information. They are not legal, tax, immigration, accounting, investment or financial advice, and they do not take account of your circumstances.

Any figure for rental income, yield, return, appreciation, financing or ownership cost is an illustration, not a promise or a recommendation. Speak to a qualified professional before acting on any of it. Section 16 of our Privacy Policy explains that reading an article does not add you to any list.

When you submit the contact form, the callback form or a property inquiry, you are asking us and our agent to respond using the details you give.

Accepting these Terms is not consent to marketing. Your consent to calls and texts is given separately, through the call consent box on the form, and your consent to marketing email is given separately, through the subscribe box. Neither is a condition of buying anything. Section 7 of our Privacy Policy explains how we contact you and how to withdraw consent, including by replying STOP to a text message.

We are committed to equal housing opportunity and comply with federal, Florida and local fair housing laws. You may not use the Site or its information to discriminate in housing on any basis those laws prohibit, or to help anyone else do so. Our Fair Housing Notice sets out our commitment in full.

You may not use the Site, its listings or its contact details to harass, threaten, deceive, impersonate or defraud anyone.

We give you a limited, personal, non-exclusive, non-transferable and revocable license to use the Site and its content for your own lawful, non-commercial purposes, in line with these Terms. We and the other rights holders named in Section 12 keep every right not expressly given to you here.

Unless we agree in writing, you may not:

• copy, republish, sell, license or commercially use Site content or listing data;
• scrape, crawl, harvest or data-mine the Site by automated or systematic means, other than ordinary search-engine indexing that follows our robots.txt;
• use listing data, photographs, descriptions, articles or other Site content to build, train, fine-tune, evaluate or supply a machine-learning or generative AI system, including through embeddings or retrieval;
• get around security features, access restrictions, rate limits or our cookie and consent controls;
• reverse engineer or decompile the Site, except where the law expressly allows it;
• send spam, malware, automated inquiries or anything that interferes with the Site or with anyone else’s use of it;
• use the Site or its listing data in breach of the law, an MLS rule, a data license or anyone’s rights.

The Site’s design, software, original articles, graphics and branding belong to Bonadomus or its licensors and are protected by copyright and trademark law.

Listing photographs, remarks, floor plans, renderings, maps and logos belong to the MLS, listing brokers, developers, photographers and other rights holders. Seeing them on the Site gives you no right to reuse them.

If you believe something on the Site infringes your copyright, write to [email protected] with the work concerned, where it appears on the Site, and your contact details. We review every notice and remove material where the claim is valid.

Only submit information that is accurate and that you have the right to give us. Do not submit anything unlawful, fraudulent, threatening, infringing or malicious. Do not submit anyone else’s details without their permission.

You keep any rights you have in what you submit. We handle it exactly as our Privacy Policy describes: who receives it (Section 8), where it is handled (Section 10), how long we keep it (Section 11) and the rights you have over it (Section 13). These Terms give us no broader right to use it.

The Site links to developer websites, virtual tours, maps and other external references, and lets you contact us through WhatsApp, Telegram and Viber. The Site also uses Google services, as described in our Cookie Policy.

We do not control these websites and services and are not responsible for their content, availability, security or privacy practices. Your use of them is governed by their own terms and policies. Read them before you give them your information.

Our Privacy Policy explains what personal information we collect, why, who receives it, and your rights, including how to opt out of sale, sharing and targeted advertising through the Your Privacy Choices link. Our Cookie Policy lists every cookie on the Site and explains the consent banner, the cookie settings link and Global Privacy Control.

On any question about personal information or cookies, the Privacy Policy and Cookie Policy apply, and they take priority over these Terms if the two ever differ.

We can change, suspend or remove any part of the Site, including listings, at any time, for example to comply with the law or an MLS rule, for security, or when a provider changes. We do not promise that the Site, or any listing or feature on it, will always be available or free of errors.

TO THE FULLEST EXTENT THE LAW ALLOWS, THE SITE AND EVERYTHING ON IT IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND AVAILABILITY.

IN PARTICULAR, WE DO NOT WARRANT THAT LISTING DATA, MLS DATA, DEVELOPER INFORMATION, MARKET DATA, PRICES, AVAILABILITY OR MEASUREMENTS ARE COMPLETE, CURRENT OR FREE OF ERRORS.

Some states do not allow certain warranty exclusions, so some of these exclusions do not apply to you.

TO THE FULLEST EXTENT THE LAW ALLOWS, BONADOMUS AND THE PEOPLE AND SERVICE PROVIDERS ACTING FOR IT ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOST DATA OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR RELIANCE ON THE SITE.

Nothing in these Terms limits liability that the law does not allow to be limited. This section does not affect any rights you have under a brokerage agreement, a transaction document, or a licensed professional’s legal obligations.

To the extent the law allows, you agree to cover Bonadomus and its staff, contractors and service providers against third-party claims, losses and reasonable costs caused by your breach of these Terms, your unlawful use of the Site, or anything you submit that infringes someone else’s rights. This does not make you responsible for anyone’s own unlawful conduct.

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules.

Before starting a formal claim about the Site, write to [email protected] describing the problem, and give us 30 days to try to resolve it with you.

Any dispute about these Terms or the Site that is not resolved that way goes to the state courts in Miami-Dade County, Florida, or the federal court for the Southern District of Florida. A dispute about a transaction is governed by the agreements for that transaction.

We update these Terms when the Site, our services or the law changes. The date at the top always shows the current version. If we make a change that materially affects you, we will say so prominently on the Site before it takes effect. A change applies only to use of the Site after it takes effect.

A change to these Terms does not by itself give us your consent to anything. Where the law requires your consent, we will ask for it separately.

If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a term, we have not waived it. You may not transfer your rights under these Terms. We may transfer ours as part of a sale of our business, as Section 8.1 of our Privacy Policy describes.

If a signed agreement, a legally required disclosure, an MLS rule or a transaction document conflicts with these Terms, that more specific document controls on its own subject.
